These Terms of Service ("Terms") govern your use of giftifymall.com (the "Site") and any purchase you make from Giftify Mall ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms.

1. Who we are

2. Eligibility

You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order. By ordering you confirm that the payment method you use belongs to you or that you are authorized to use it.

3. Products and personalization

All products sold on this Site are physical goods that are personalized and manufactured to order. You supply the personalization content — names, dates, messages, and photographs — during checkout.

You are responsible for the accuracy of what you submit. We print exactly what you enter and approve in the design preview, including spelling and punctuation. See our Refund & Return Policy for what happens if we make a mistake.

4. Content you upload

By uploading a photograph or submitting text, you represent and warrant that:

You own the content, or have permission from the copyright owner to use it
You have the consent of any identifiable person appearing in a photograph
The content does not infringe any trademark, copyright, or other right
The content is not unlawful, hateful, defamatory, obscene, or threatening

You grant us a limited licence to reproduce your content solely for the purpose of producing and delivering your order. We do not use customer photographs for marketing without separate written permission.

We reserve the right to refuse or cancel any order whose content we reasonably believe violates this section, and will refund it in full.

5. Our intellectual property

All designs, artwork, templates, product photography, text, and the layout of this Site are owned by Giftify Mall or licensed to us. You may not reproduce, resell, or create derivative works from them without written permission.

6. Pricing and payment

All prices are shown in US Dollars (USD) and exclude sales tax and shipping, which are calculated and displayed at checkout before payment. We reserve the right to correct pricing errors and to cancel and fully refund any order placed at an incorrect price.

Payment is processed by our payment provider. We do not store your full card details on our servers. Your card is charged at the time of purchase, when production is committed.

7. Order acceptance

Your order is an offer to buy. We accept it when we send your shipping confirmation. We may decline or cancel an order — with a full refund — for reasons including product unavailability, suspected fraud, errors in pricing or description, or content that violates Section 4.

8. Shipping, returns and refunds

Delivery timelines are set out in our Shipping Policy. Returns, replacements and refunds are governed by our Refund & Return Policy. Both are incorporated into these Terms by reference.

9. Product appearance

We photograph and describe our products as accurately as we can. Screen calibration, monitor settings, and the natural variation of materials such as ceramic, wood, glass, and dyed fabric mean the item you receive may differ slightly in color or grain from the images shown. This variation is not a defect.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to your order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including missed occasions caused by carrier delay. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Washington State.

12. Changes

We may update these Terms from time to time. The version in force is the one published on this page at the moment you place your order. Material changes will be reflected in the "Last updated" date above.
